    A. THESE CONTEST RULES (“CONTEST RULES”) ESTABLISH THE GENERAL TERMS AND CONDITIONS FOR THIS “FALL RATINGS” CONTEST (“CONTEST”) FOR PLAYERS OF THE ONLINE GAME “WORLD OF WARPLANES” PLAYING ON THE NA GAME CLUSTER (THE AMERICAS), EU GAME CLUSTER (EUROPE), RU GAME CLUSTER (CIS), OR ASIA GAME CLUSTER (ASIA-PACIFIC). THE CONTEST RULES CONSIST OF GENERAL CONTEST RULES (PART A) AND SPECIFIC CONTEST RULES (PART B).

    B. NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN THIS CONTEST. A PURCHASE WILL NOT IMPROVE THE CHANCES OF WINNING.

    C. THIS CONTEST IS OPEN TO INDIVIDUALS WHO ARE OF AGE OF MAJORITY UNDER THE LAW OF THEIR STATE OF RESIDENCE. INDIVIDUALS WHO ARE UNDER THE AGE OF MAJORITY MAY PARTICIPATE ONLY IF THE PARENTS OR GUARDIANS OF THESE INDIVIDUALS CONSENT TO THEIR PARTICIPATION IN THE CONTEST ON THE TERMS ESTABLISHED BY THESE RULES.

    GENERAL CONTEST RULES

    Part A

    1. Sponsor

    This Contest – “Fall Ratings” is organized by Wargaming Group Limited, (the “Sponsor”), 105 Agion Omologiton Avenue, Nicosia 1080, Cyprus.

    2. Eligibility

    (a) Participation in this Contest is open only to individuals who enter in accordance with these Contest Rules. Individuals residing in Brazil, Hong Kong, Vietnam, or the province of Quebec (Canada) are NOT ELIGIBLE to win prizes in this Contest. The Sponsor will use the country of the individuals’ Wargaming accounts to determine the country of residence.

    (b) If an individual is under the age of majority, this individual may participate in the Contest only if the parents or guardians of this individual consent to his/her participation in the Contest. The Sponsor can request written confirmation of such consent at any time. If such confirmation is not presented upon the Sponsor’s request by the individual participating/wishing to participate in the Contest, the Sponsor has the right to disqualify this individual.

    3. Claiming a Prize

    The Prize winners will be notified of their win through World of Warplanes game client and/or email. Regulations for granting the prizes are set out in the specific part of these Contest Rules, Part B.

    The Sponsor may require the Prize winner to provide additional documents for taxation-related purposes or to confirm eligibility for participation.

    The Sponsor reserves the right to substitute a prize or any part thereof with a prize or element of equal or greater value in its sole discretion. If a Prize winner is not in compliance with these Contest Rules, this Prize winner will be disqualified.

    4. Release of Liability by Participant

    (a) The liability of the Sponsor is unlimited for damages caused by the Sponsor or Sponsor Parties by intent or gross negligence.
    (b) In case of a slight negligent breach of a contractual core duty, the Sponsor and/or Sponsor Parties shall, except in the cases pursuant to clause 4 (c), only be liable to the amount of the typically foreseeable damage. Contractual core duties abstractly are such duties accomplishment of which enables proper fulfilment of the contract in the first place and fulfilment of which a contractual party may regularly rely on.
    (c) Liability stipulated by applicable law remains unaffected.
    (d) The limitation period for claims for damages shall be six (6) months, except in case of clause 4 (a) and 4 (c) where the statutory statute of limitations shall apply.

    5. Tampering

    (a) The Sponsor reserves the right to disqualify and prohibit from participating any person, who is attempting to or has attempted to: (i) tamper with the Sponsor’s website and/or any part of the Contest; (ii) undermine the legitimate operation of the Contest by cheating, deception, or other unfair playing practices, (iii) annoy, abuse, threaten, or harass any other Participants; and/or (iv) otherwise violate these Contest Rules or the World of Warplanes End User License Agreement, if applicable.

    (b) ANY ATTEMPT TO DELIBERATELY DAMAGE THE SPONSOR’S WEBSITE OR ANY OF THE SPONSOR’S GAMES (OR ANY PART OF EITHER) OR UNDERMINE THE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD ANY SUCH ATTEMPT BE MADE, THE SPONSOR AND ITS LICENSEES (IF ANY) RESERVE THE RIGHT TO SEEK DAMAGES AND ANY OTHER AVAILABLE REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR ANY SUCH ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. EACH PARTICIPANT (OR, IF THE PARTICIPANT IS NOT OF AGE OF MAJORITY IN HIS/HER STATE OF RESIDENCE, THE LEGAL GUARDIANS THEREOF) AGREES TO INDEMNIFY AND HOLD THE SPONSOR HARMLESS FROM AND AGAINST ANY AND ALL CLAIMS, LOSSES, DAMAGES, AND/OR LIABILITIES (INCLUDING REASONABLE ATTORNEYS’ FEES AND EXPENSES) THAT MAY BE ASSERTED AGAINST OR INCURRED BY ANY OF THEM AT ANY TIME, IN CONNECTION WITH PARTICIPANT’S BREACHES OF ANY REPRESENTATION, WARRANTIES, OR COVENANTS ASSOCIATED WITH THIS CONTEST.

    6. Sponsor’s Right to Disqualify Participants and Terminate this Contest

    If there is any actual evidence of fraud, electronic or non-electronic tampering, or unauthorized intervention with any portion of this Contest, or if fraud or technical difficulties of any sort (e.g., computer viruses, bugs, server errors) compromise the integrity of the Contest, the Sponsor reserves the right to disqualify suspect Participants and/or terminate the Contest. The use of any automated launching or entry software or any other mechanical or electronic means that permits the Participant to automatically enter, participate is prohibited. In the event of a dispute as to the identity of a Participant based on an email address, the Participant may be disqualified.

    7. General Terms

    (a) This Contest is subject to these Contest Rules and is governed by the laws of the Republic of Cyprus. To the extent that the local law deprives the Participant of the protection afforded to him/her by provisions that cannot be derogated by virtue of the law of the country where the Participant has his/her habitual residence, the law of that country applies. The provisions of these Contest Rules do not exclude, limit, or otherwise restrict the rights vested with the consumers upon relevant provisions of the applicable law nor may be construed by anyone in this way. By entering, each Participant agrees (or if a Participant is under the age of majority in his/her state of residence, his/her parent and/or legal guardian agrees) to comply with these Contest Rules and the World of Warplanes End User License Agreement, if applicable.

    (b) In order to validly enter and in order to claim the Prize, Participants may be required to provide the Sponsor with certain personally identifiable information under these Rules. Such information may be used for the purposes specifically described in these Contest Rules.

    (c) The invalidity or unenforceability of any provision of these Contest Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Contest Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.

    (d) All taxes, fees, and surcharges on the Prize shall be borne solely by the Prize winner.

    SPECIFIC CONTEST RULES

    Part B

    1. Contest

    The Contest is a competition among World of Warplanes players, where the participating individuals (“Participants”) compete for prizes specified below (“Prizes”).

    2. Contest Period

    Contest Period: UTC+3 20.09.2021 19:00 – 03.10.2021 23:00

    Game server: eu.wargaming.net
    Contest Period: UTC+2 (CEST) 20.09.2021 19:00 – 03.10.2021 23:00

    Game server: asia.wargaming.net
    Contest Period: UTC+9 (JST) 20.09.2021 19:00 – 03.10.2021 23:00

    Game server: na.wargaming.net
    Contest Period: UTC-4 (EDT) 20.09.2021 19:00 – 03.10.2021 23:00, NA UTC-7 (PDT) 20.09.2021 16:00 – 03.10.2021 20:00

    3. Participation

    Every player who fights at least one World of Warplanes battle of the Standard Battle type in aircraft of Tier V or higher during the Contest Period and scores at least one capture point during this battle is automatically considered a Participant.

    4. Contest Mechanics
    Participants can earn capture points in World of Warplanes’ Standard Battles during the Contest Period. The Participant’s result in the Contest depends on the total number of capture points earned during the Contest Period.

    5. Prizes

    Each game cluster has its own list of winners of the Contest.

    The Prizes are awarded to the Participants as follows.

    Participants playing on the CIS game server (ru.wargaming.net) are ranked by the total number of capture points earned according to section 5 of these Rules, and:

      – Participants taking places 1–55 receive the Super Cup prize;
      – Participants taking places 56–330 receive the Golden Cup prize;
      – Participants taking places 331–880 receive the Silver Cup prize;
      – Participants taking places 881–1500 receive the Bronze Cup prize;
      – Participants taking places 1501–2500 receive the “Competitor Badge” prize.

    Participants playing on the EU game server (eu.wargaming.net) are ranked by the total number of capture points earned according to section 5 of these Rules, and:

      – Participants taking places 1–30 receive the Super Cup prize;
      – Participants taking places 31–180 receive the Golden Cup prize;
      – Participants taking places 181–480 receive the Silver Cup prize;
      – Participants taking places 481–1000 receive the Bronze Cup prize;
      – Participants taking places 1001–2000 receive the Competitor Badge prize.

    Participants playing on the NA game server (na.wargaming.net) are ranked by the total number of capture points earned according to section 5 of these Rules, and:

      – Participants taking places 1–15 receive the Super Cup prize;
      – Participants taking places 16–90 receive the Golden Cup prize;
      – Participants taking places 91–240 receive the Silver Cup prize;
      – Participants taking places 241–400 receive the Bronze Cup prize;
      – Participants taking places 401–800 receive the Competitor Badge prize.

    Participants playing on the ASIA game server (asia.wargaming.net) are ranked by the total number of capture points earned according to section 5 of these Rules, and:

      – Participants taking places 1–5 receive the Super Cup prize;
      – Participants taking places 6–30 receive the Golden Cup prize;
      – Participants taking places 31–80 receive the Silver Cup prize;
      – Participants taking places 81–300 receive the Bronze Cup prize;
      – Participants taking places 301–500 receive the Competitor Badge prize.

    The Super Cup prize includes:
    1. Unique non-fungible token (NFT) of thematic art*;
    2. In-game prizes: Ultimate Experimental Collimator Gunsight, Ultimate Experimental Gyroscopic Gunsight, Steel Supply Crate, 750 Gold.

    The Golden Cup prize includes:
    1. Unique non-fungible token (NFT) of thematic art*;
    2. In-game prizes: Advanced Experimental Collimator Gunsight, Advanced Experimental Gyroscopic Gunsight, Unique Supply, 375 Gold.

    The Silver Cup prize includes:
    1. Unique non-fungible token (NFT) of thematic art*;
    2. In-game prizes: Improved Experimental Collimator Gunsight, Improved Experimental Gyroscopic Gunsight, Supply Crate, 225 Gold.

    The Bronze Cup prize includes:

    In-game prizes: Stock Experimental Collimator Gunsight, Stock Experimental Gyroscopic Gunsight, 150 Gold.

    The Competitor Badge prize includes:

    In-game prize: 50 Gold.

    *Depending on which game server the winner is playing on, the thematic art is:

    Game server: na.wargaming.net
    Thematic art: Image of a unique US pilot specialized in the legendary bomber B-17G (Tier VI). The image background differs depending on whether the NFT is obtained as part of the Super Cup, Golden Cup, or Silver Cup prize.

    Game server: eu.wargaming.net
    Thematic art: Image of a unique British pilot specialized in the legendary multirole fighter Tornado (Tier VI). The image background differs depending on whether the NFT is obtained as part of the Super Cup, Golden Cup, or Silver Cup prize.

    Game server: ru.wargaming.net
    Thematic art: Image of a unique Soviet pilot specialized in the legendary fighter La-5 (Tier VI). The image background differs depending on whether the NFT is obtained as part of the Super Cup, Golden Cup, or Silver Cup prize.

    Game server: asia.wargaming.net
    Thematic art: Image of a unique Japanese female pilot specialized in the legendary fighter A6M5 (Tier VI). The image background differs depending on whether the NFT is obtained as part of the Super Cup, Golden Cup, or Silver Cup prize.

    The NFTs awarded to the players of the same game server as part of the Prize of the same tier (i.e. the Super Cup, or Golden Cup, or Silver Cup) have the same content (thematic art), but each is uniquely identifiable on the Ethereum blockchain.

    6. Prizes Receipt

    In-game Prizes will be automatically credited to the accounts of their respective winners within seven days since the end of the Contest Period.

    The Prizes in the form of NFTs will be provided as follows:

    To receive the NFT, a winner needs to claim it through a separate landing page within 7 (seven) days after the landing page becomes available. After this, players will not be able to claim the NFT, and all unclaimed NFTs will become unavailable. The landing page can be accessed by clicking the in-game poster dedicated to the Contest that will be displayed in World of Warplanes upon login no later than October 6, 2021.

    At the landing page, the winner has to insert his/her Ethereum address, which will be provided to the Sponsor’s partner Enjin Pte. Ltd. (16 Raffles Quay, #33-03 Hong Leong Building, Singapore 048581), the platform that will provide the NFT to the winner. If the winner has no Ethereum address, he/she can obtain such address at https://enjin.io/ platform directly.

    From the moment a winner provides the Ethereum address via the landing page or initiates creation of a new Ethereum address at https://enjin.io/, the Sponsor is not involved in the process of, and shall not be responsible for, the process of creation of the Ethereum address or transfer of the NFT to the winner, which will be performed by Enjin Pte. If facing issues with this process, the winner should contact Enjin Pte. for support.

    Due to the technology of transfer of the NFT to the respective winner’s Ethereum address, if a wrong address is specified by the winner, the NFT cannot be provided, and no corrections or repeated attempts are possible. The transfer of the NFT can take up to several days, and the Sponsor shall not be liable for any delays in this regard.

    The functioning and operation of the NFT after it is provided to the winner is outside of the Sponsor’s control and the Sponsor shall not be responsible for any issue in such functioning and operation.

    All banking commissions, retentions, deductions, taxes, including income tax, as well as any other expenses (if any) in respect of prize receipt, shall be borne by the Prize winner.

    The possibility of displaying the content of the NFT and of NFT metadata depends on the blockchain wallet used by the respective winner and may vary.

    Due to local legal limitations in Japan, if Participants residing in Japan win any of the Prizes, such Participants must enter into an additional agreement with the Sponsor to receive payment.

    7. License

    Each Participant agrees that his/her use of the NFT will be subject to the End User License Agreement available at: https://legal.eu.wargaming.net/en/nft/
